No suit at law nor any statutory proceeding shall be dismissed for want of necessary parties, but the court shall have power to cause them to be summoned. In case another defendant is added, summons may issue against such defendant, returnable to any day certain, to be fixed by order or rule of court, not less than ten days after the issuance of such summons, and he may he proceeded against in the same manner as if he had been made a defendant at the commencement of the suit.
