The contributors to this book examine the prospects for unified government during the Clinton presidency and, looking to the future, discuss possibilities for structural reform--in the political parties, in campaigning, in the Congress, and through amendments to the Constitution. The book draws on papers and comments presented at a ""Government in Gridlock"" conference cosponsored by Brookings and the Committee on the Constitutional System shortly after the inauguration of President Clinton.

    2018 年和 2019 年这两年时间里,我一直在写一部题为“制宪权导论”的专著。在写作过程中,我集中研读了不少西方政治与宪法思想史上的经典著作,并参阅了不少与之相关的研究论著。在此过程中,我特别注意各种不同的政治学说,是如何促进或阻碍了现代宪法的产生。通过这样的阅读、思考和写作,我自觉对现代宪法的目的、原则、内容和制度构造,有了比以前更为系统和深入的理解。为了理解现代宪法是如何运作的,我用了很多时间去研究它是如何产生的。在本书中,我考察了组成现代宪法体制的若干政治观念,是如何被提出、被改造以及最终被整合在一起的。这本书的内容,一方面是向读者展示现代宪法在各种政治思想推动下的产生过程,另一方面也是透过现代宪法的制度框架,去分析相关政治观念的内容和作用。我在书中用两章的篇幅分析现代宪政体制在英国出现的经过(从大宪章到光荣革命),是想用历史事实去检验本书的理论部分,也就是要表明:只有当一个政治共同体的成员广泛认同若干不可或缺的原则,并将它们一起加以采用,才可能建立稳定的宪政体制。我另用一章的篇幅分析法国大革命从开始到失败的经过,是为了表明:如果人们对这些原则的理解出了偏差,或者只是选择性地采用其中的一部分,就不可能建立稳定的宪政体制。在这本书中,我完全没有谈及自晚清以来的中国宪法实践和学说,尽管我希望本书的写作与出版,能为中国大陆的宪法学研究奠定正确的理论基础。
