Todo ciudadano puede recabar la tutela de los derechos fundamentales y libertades ante los órganos jurisdiccionales ordinarios al ser éstos los guardianes naturales y primeros garantes de dispensar esa tutela. Cuando las vías ordinarias de protección resultan insatisfactorias y, una vez agotadas las demás vías judiciales previas mediante los recursos útiles, queda expedita la vía del recurso de amparo, ante el Tribunal Constitucional que es el guardián de las garantías constitucionales y garante último de la Constitución, con el fin de restablecer y preservar en caso de violación los derechos y libertades reconocidos en el artículo 24 de la Constitución bajo el amplio manto de la tutela judicial efectiva y sus poliédricos aspectos instrumentales contenidos una y otra en el citado artículo. Las resoluciones de dicho Tribunal, su doctrina y jurisprudencia están en constante evolución en consonancia con las sentencias del Tribunal Europeo de Derechos Humanos y las exigencias del Convenio Europeo de Derechos Humanos.
