Obwohl es in der Insolvenzordnung seit Marz 2003 eine ausfuhrliche Regelung von Teilbereichen des deutschen internationalen Insolvenzrechts gibt und auf europaischer Ebene die Verordnung des Rates uber Insolvenzverfahren in Kraft getreten ist, ist es notwendig, Voraussetzungen und Wirkungen der Anerkennung auslandischer Insolvenzentscheidungen selbst zu bestimmen. Nach einer Bestandsaufnahme des geltenden Rechts und einer Standortbestimmung des deutschen internationalen Insolvenzrechts im Rechtsvergleich und im Rahmen der Europaischen Union klart die Autorin die Grundlagen der Anerkennung auslandischer Insolvenzentscheidungen. Dabei befasst sie sich mit den von der gesetzlichen Neuregelung offengelassenen Fragen und der Einordnung der anerkennungsrechtlichen Grundnorm - namlich des neuen 343 Abs.1 InsO - in das bestehende internationale Privat- und Verfahrensrecht. Ziel ist es, die anerkennungsfahigen Inlandswirkungen einer auslandischen Insolvenzentscheidung nach autonomem deutschen internationalen Insolvenzrecht zu bestimmen und von den durch kollisionsrechtliche Anknupfung einer sachnahen Rechtsordnung zuzuweisenden Fragen zu unterscheiden.
