English summary: Jorg Dilger retraces the evolution of the new EU matrimonial regulation which is going to replace the old regulation (EC) No. 1347/2000 (Brussels II Regulation) as of March 1st 2005. After analyzing the scope of the regulation, he compares the jurisdiction criteria, the different bases for jurisdiction as well as the lis pendens rule stipulated in the regulation. Mai 1999 in Kraft getretene Vertrag von Amsterdam hat mit Art. 65 EG eine Norm geschaffen, die das europaische internationale Privat- und Zivilverfahrensrecht auf eine neue Grundlage stellt. Von dieser neuen Rechtsetzungskompetenz hat der Gemeinschaftsgesetzgeber schnell und umfassend Gebrauch gemacht. Die erste auf dieser Grundlage in Kraft gesetzte Verordnung (EG) Nr. 1347/2000 vom 29. Mai 2000 steht indes bereits drei Jahre nach ihrem In-Kraft-Treten kurz vor ihrer Ablosung durch die Verordnung (EG) Nr. 2201/2003 vom 27. November 2003 (EheeVGVVO). Jorg Dilger zeichnet die Entstehung sowie den staatsvertraglichen und den gemeinschaftsrechtlichen Kontext der EheeVGVVO, die zum 1. Marz 2005 in Kraft treten wird, nach. Nach einer Darstellung ihres Anwendungsbereiches erlautert und analysiert er neben den zustandigkeitsrelevanten Anknupfungsmomenten rechtsvergleichend die einzelnen Entscheidungszustandigkeiten der EheeVGVVO sowie deren Rechtshangigkeitsregelung. Hierbei richtet er unter anderem sein besonderes Augenmerk auf die Frage, ob die in der EheeVGVVO vorgesehene zustandigkeitsbegrundende Anknupfung an die Staatsangehorigkeit bzw. an das domicile mit dem in Art. 12 EG festgeschriebenen Diskriminierungsverbot vereinbar ist.
