English summary: In its decision Jahn vs. Germany, the European Court of Human Rights found that a taking of property without compensation may under exceptional circumstances be in accordance with the European Convention on Human Rights. While presenting a vivid analysis of the Court's jurisdiction regarding the right to property, Birgit Fischborn explores the question of whether an exception to the principle of compensation is in accordance with the Convention. Referring to general principles of international law and decisions of international arbitration panels, she undertakes to describe the term exceptional circumstances. By defining this term and examining the doctrines of the Court with regard to the right to property in detail, she contributes to the principle of legal certainty in view of future cases of violations of property rights. Die Autorin untersucht mittels differenzierter Analyse der Rechtsprechung des Gerichtshofs im Vergleich zum allgemeinen Volkerrecht und zu Entscheidungen internationaler Schiedsgerichte, ob und unter welchen Umstanden von dem Entschadigungsgrundsatz Ausnahmen gemacht werden konnen. Dabei leistet sie durch die Aufarbeitung der Eigentumsdogmatik des Gerichtshofs und die ausdifferenzierte Betrachtung des von diesem herangezogenen Begriffs der aussergewohnlichen Umstande einen Beitrag zu grosserer Rechtssicherheit bei der Einordnung und Abgrenzung kunftiger Enteignungsfalle.
