Die Autorin untersucht mittels differenzierter Analyse der Rechtsprechung des Gerichtshofs im Vergleich zum allgemeinen Volkerrecht und zu Entscheidungen internationaler Schiedsgerichte, ob und unter welchen Umstanden von dem Entschadigungsgrundsatz Ausnahmen gemacht werden konnen. Dabei leistet sie durch die Aufarbeitung der Eigentumsdogmatik des Gerichtshofs und die ausdifferenzierte Betrachtung des von diesem herangezogenen Begriffs der aussergewohnlichen Umstande einen Beitrag zu grosserer Rechtssicherheit bei der Einordnung und Abgrenzung kunftiger Enteignungsfalle.
