English summary: Thieves, murderers and arsonists render themselves liable to prosecution if they commit robbery, murder or arson. Their punishment is necessary and self-evident. Although this necessity cannot be seriously denied even among judges, their punishment is by no means a matter of course. Christina Putzke deals with the difficulties that arise in this context and shows that these problems can be solved. According to the clarification she provides, judges could also be punished as a matter of course for a perversion of justice. Christina Putzke widmet sich den insoweit auftretenden Schwierigkeiten und zeigt auf, dass es sich - auf dem Boden des Gesetzes - durchweg um losbare Probleme handelt.Im Mittelpunkt steht dabei das tatbestandsmassige Verhalten, das in Kollegialgerichten bislang uberwiegend in der Zustimmung zu der rechtsbeugenden Entscheidung erblickt wird. Wer hingegen konsequent strafrechtliche Zurechnungskriterien zugrunde legt, erkennt, dass die Strafbarkeit am Inkraftsetzen der rechtsbeugenden Entscheidung zu orientieren ist. Auf dem Weg zur Bestimmung des tatbestandsmassigen Verhaltens widmet sich die Autorin intensiv dem Problem der Kausalitat bei Gremienentscheidungen und dem richterlichen Beratungsgeheimnis. Nach diesen Klarungen konnte nun auch fur Richter, wenn sie das Recht beugen, die Bestrafung zur Selbstverstandlichkeit werden.
