Dabei erweisen sich das Äquivalenz- und das Effektivitätsprinzip als spezifischer Ausdruck des Grundsatzes der Verhältnismäßigkeit. Dies führt zu einer umfassenden Kritik der Rechtsprechung des Europäischen Gerichtshofs im Hinblick auf die Bestandskraft von Verwaltungsakten und die Rechtskraft von Gerichtsentscheidungen.
