Das NS-Regime zielte von Anfang an darauf ab, während des Zweiten Weltkriegs im Bereich des alltäglichen Wirtschaftens der nicht verfolgten Bevölkerungsmehrheit an der "Heimatfront" von vornherein jene Probleme zu vermeiden, von denen anhand der Erinnerung an den Ersten Weltkrieg eine Wiederkehr erwartet wurde. Unter anderem Preis- und Marktregulierung, Kriegsverfahrensrecht und eine äußerst weit gefasste Reichshaftung für Kriegsschäden sorgten dafür, dass eine Reihe von Themen gar nicht oder nur auf Umwegen der Gegenstand von Zivilprozessen vor Ort werden konnten. Bei Schadensersatzprozessen und besonders bei Verkehrsunfällen mit Wehrmachtbeteiligung war dies jedoch anders: Hier wurde die schon vor Kriegsbeginn nachweisbare Tendenz, die Amtshaftung im als "unpolitisch" deklarierten Bereich auszubauen, zum Sprungbrett dafür, die im übrigen Rechtssystem verankerte Kriegsfolgenkompensation in Zivilurteilen nachzubilden, ohne dass dies vom Regime explizit angeordnet worden wäre.
