Dabei knupft die Autorin im Wesentlichen an zwei Gesichtspunkte an: Zunachst werden die geschutzten Rechtsguter ermittelt, um ein Fundament fur eine glaubwurdige und nachvollziehbare Legitimation der strafrechtlichen Sanktionsmechanismen zu schaffen. Sodann wird vor dem Hintergrund des im Bereich des geistigen Eigentums bestehenden Gleichlaufs von Straf- und Zivilrecht sowie der damit einhergehenden Weite des Strafbarkeitsbereichs die Notwendigkeit der Einfuhrung einer Erheblichkeitsschwelle diskutiert.
