Susanne Karoline Paas geht dieser Geschichte erstmals auf den Grund: von der "Entdeckung" des beweglichen Systems durch Walter Wilburg in der Zeit des Nationalsozialismus uber seine Adaptionen durch Franz Bydlinski und Claus-Wilhelm Canaris ab den spaten sechziger Jahren bis zu seinen zahlreichen Verwendungen in der gegenwartigen Rechtswissenschaft. Die These der rechtsgeschichtlichen Forschung, das bewegliche System sei eine typisch nationalsozialistische Rechtslehre, erweist sich dabei als ebenso korrekturbedurftig wie das Bild von Wilburg als Entdecker eines neuen System- und Methodendenkens, dem dann einfach gefolgt worden sei. Am Ende stehen "bewegliche Systeme", die in verschiedenen Kontexten ganz unterschiedliche dogmatische und rechtspolitische Probleme losen sollten.
