Darüber hinaus werden Reformpunkte des Datenschutzrechts und neue Erkenntnisse aus dem Kunstrecht (Provenienzforschung) mit urheberrechtlichen Vorzeichen gewürdigt. Der Band macht deutlich, dass der in allen Zeiten bestehende Interessenkonflikt zwischen Werkschöpfer, Verwerter und Nutzer mit vorgefertigten Schablonen nicht zu lösen ist. The contributors deal with the wide range of historical problems and unresolved questions of copyright law. They range from a case of plagiarism by the humanist Lorenzo Valla to criticism of the draft copyright law of 1870 and to the historical background of the German concept of a work under copyright law. In addition, reform points of data protection law and new findings from art law (provenance research) are acknowledged with copyright signs. The volume makes it clear that the conflict of interest between creators, users and users, which has always existed, cannot be solved with ready-made templates.
