專利法所涉及問題，可包含科技、管理與法律等層面，本書主要係從法律面向探討專利法律問題，使讀者認識專利法之基本法律概念與基本原理，以利專利法理論與實務問題之解決。

面對現代科技日益精進與挑戰，專利法應採取何種政策與規範，以利回應新興科技進步衍生問題之挑戰，本書嘗試就專利法之基礎問題，試從專利法制面探討我們應該思考之專利法制問題。因此，本書主要係就專利法之基本概念、要件、效力與相關救濟規範內容，精要地加以論述，以期提供對專利法有興趣者學習之基礎教材。書中對於專利法之規範重點與從專利法發展與參考外國重要立法例，引用法院判決，藉以觀察與比較專利概念與要件等基本問題之演變，以期讀者更深入理解專利法之重要概念與原則，以利實務上運用及研究專利法者之參考。
