確認事實，向來是司法判決最為艱難之處。
性侵害案件通常發生在密室，少有直接明確的人證或物證，如果事後雙方說詞迥異，被害人又是認知與表達能力有限的兒童，如何斷定發生了什麼事？執法者是否可能因個人隧道視野、迷信科學證據、過度依賴單方證詞而造成錯誤──無論是縱放了真正的犯人，或是誤判了無罪的被告？
 
這裡牽涉到許多值得思考的問題：無罪推定是什麼意思？證據法則又是什麼？性侵害案件的證據要到什麼程度，才會判決被告有罪？對性侵害案件的證據要求，可不可以與其他案件有所不同？如果一樣會怎麼樣？不一樣又會怎麼樣？
 
陳昭如長期關注性侵被害人的處境，亦深入理解性侵冤案的來龍去脈。這次她挑戰探討兒童性侵害案件認定的兩難，並指出無論是眾聲沉默的性侵案，或是被迫消音的性侵冤案，都是在性（侵）是羞恥的文化之下，讓「不可說」的氛圍製造出驚人的黑暗與混沌。期盼每個人都反躬自省，側耳聆聽，瞭解這個議題的複雜性，讓不同角色的痛苦被聽見，透過不斷的思辨與說理，往解決的方向前進一步。
