El presente documento se pregunta cómo definir la situación jurídica de los comparecientes que no hayan tenido participación determinante en los crímenes más graves y representativos ante la Jurisdicción Especial para la Paz (JEP). Mientras que la situación jurídica de los máximos responsables en estos crímenes tiene que ser definida por vía de selección y sanción, la de los comparecientes con participación no determinante puede variar entre tratamientos penales especiales no sancionatorios (rutas de selección negativa) o, excepcionalmente, la selección con fines de imponer sanciones propias o alternativas inferiores a cinco años (rutas de selección positiva excepcional). En ese sentido, las preguntas principales que orientan esta reflexión son: ¿qué es la participación no determinante en los crímenes más graves y representativos? y ¿cómo definir la situación jurídica de aquellos comparecientes que pertenecen a esta categoría? El propósito de este documento es estudiar distintas opciones y su conveniencia para el trabajo de la JEP. Así, el texto se divide en tres partes. La primera examina el concepto de participación no determinante en los crímenes más graves y representativos. La segunda describe la definición de las situaciones jurídicas mediante el proceso de selección gradual, en las rutas de selección positiva excepcional y las rutas de selección negativa (o no selección) de los partícipes no determinantes. Para finalizar, la tercera plantea algunas recomendaciones sobre el tratamiento penal especial de estos comparecientes en la JEP.
