En el contexto de la investigación por macrocasos que debe adelantar la Sala de Reconocimiento de Verdad y Responsabilidad (SRVR) de la Jurisdicción Especial para la Paz (JEP), la SRVR debe remitir a aquellos responsables que no reconocen su responsabilidad por los crímenes más graves y representativos a la Unidad de Investigación y Acusación (UIA) para que se inicie un procedimiento adversarial. Lo que no esta del todo claro es si esta remision debería hacerse antes o después de expedirse un Auto de Determinación de Hechos y Conductas (ADHC) en el que se definen los patrones y políticas de macrocriminalidad y se identifican e imputan los máximos responsables. El presente texto analiza las implicaciones del caso de Luis Fernando Almario Rojas, el primer caso de una remisión temprana antes de la expedición de un ADHC. Una de las preocupaciones mas importantes que plantea el caso de Almario es la de cuáles son los problemas potenciales con identificar un máximo responsable en una etapa temprana, fuera de un ADHC que evalúa la máxima responsabilidad en el contexto de una determinación exhaustiva de las políticas y patrones de la macrocriminalidad en los que se da esta responsabilidad. ¿Qué elementos definen un presunto máximo responsable? ¿Se puede identificar un máximo responsable por su participación en hechos concretos? ¿Podría una remisión temprana alterar el enfoque de investigación por macrocasos hacia una investigación caso a caso? ¿Y qué repercusiones puede tener una decisión como esta para la investigación por macrocasos?
