本書以司法的視角，從界定國際民商事訴訟競合的概念入手，分析其產生的根源，評述大陸法系和普通法系各國訴訟競合法律規制的理論與實踐、法律規定與處置方法，考察國際條約關於訴訟競合的現行規定和解決途徑，綜合分析我國關於國際民商事訴訟競合的立法與司法實踐，提出完善我國相關法律規定，保護涉外民商事訴訟當事人合法權益及國家利益的建議。
