為什麼民族習慣法、村規民約等民間法現象難以成為當前法學研究的主要關注對象？其法學理論層面的原因是，我們一直在用建基於國家法現象的法學理論或國家法法哲學在審視整個世界的法現象。本書建構的“民間法哲學”，試圖喚醒從整體之法的現象視角來觀照自身的廣義法哲學觀，在建構或重構“民間法”“場域公共秩序”等核心概念的基礎上，勾勒出民間法的基石法益、基石法理、國內國際維度疆界，及其“法治中國”擔當等主題內容，確立起民間法跟國家法相對位的理論主體地位。
