La cuestión sobre el estatuto teórico y metodológico del positivismo jurídico es una de las discusiones centrales en la filosofía del derecho contemporánea. Este libro identifica el positivismo jurídico con un modo general y descriptivo de hacer teoría del derecho. Desde este punto de partida se abordan las cuestiones relativas al objetivo, caracteres y herramientas propias de esta escuela de pensamiento jurídico, aconsejando y justificando las transformaciones oportunas. Sin olvidar, por su parte, la exposición y discusión de las actuales versiones en pugna del positivismo jurídico: incluyente y excluyente. Filósofos y teóricos del derecho encontrarán en este libro un lugar desde el cual discutir las metas, instrumentos y tesis del positivismo jurídico y, en su caso, adherirse a ellas.
