Desde hace cuatro años la jurisprudencia de Juzgados y Audiencias está convulsionada y desbordada por reclamaciones de particulares contra entidades y establecimientos financieros emisores de tarjetas de crédito. La razón es la pretendida naturaleza usuraria de los intereses remuneratorios que se están cobrando en España en el sector de mercado de las tarjetas de crédito. Es un precio casi constante, en el margen entre el 20 y el 25%, unánime y normal. Todo proviene de que en 2015 el Tribunal Supremo dictó una célebre sentencia ("Sygma Mediatis") en la que - a falta en aquel entonces de otros datos más precisos- consideró que el estándar de normalidad de la Ley de Usura tiene que tomarse del interés que se viene ordinariamente cobrando en el mercado de créditos de consumo en general. A partir especialmente del año 2017, la jurisprudencia de Audiencias está dividida al respecto.
