本文整理分析在2015年2月至7月期間，美國各聯邦地院依據美國專利法第101條做出專利標的適格性實質判斷的判決或裁定，藉以觀察在後Alice案判決時代，美國法院解釋適用兩階段分析方法的發展趨勢。整理分析前述判決所得出之實證結果，或可佐證在後Alice案判決時代的確存在「專利無效浪潮」，同時亦印證了美國各聯邦地院對於商業方法專利的專利標的適格性，在Alice案判決做出後是採取較為嚴格的檢證水準。此外，本文亦就前述判決進行深度閱讀，並從中整理出美國聯邦地院透過個案審理的經驗累積，就解釋適用兩階段分析方法所發展的3項原則，可由人類執行之作業會被界定為抽象概念、技術要件缺乏明確說明會有先占問題、DDR Holdings案判決論理成為主張專利標的適格性之論據等。本文亦討論到兩階段分析方法之適用在訴訟實務上所可能產生的程序面課題，並特別指出美國各聯邦法院對於判斷專利標的適格性應適用之證據證明度要求存在歧見的問題。
