Considerar que los derechos de la propiedad industrial constituyen una verdadera propiedad resulta compatible con lo dispuesto en el régimen general del Código Civil, que en el artículo 653 señala que los bienes consisten en cosas corporales o incorporales; con lo establecido en el artículo 664, conforme al cual las cosas incorporales son derechos reales o personales, y con lo previsto en el artículo 671, según el cual las producciones de talento o del ingenio son una propiedad de sus autores.
